FBSDesigns Agreement

Handicap
FBSDesigns Online Scoring System is for tracking and entertainment purposes only.  The handicap calculated by FBSDesigns is not an official USGA handicap.  In order to obtain an official USGA handicap, you must join a golf club.  Though we provide very useful data for any golfer, our service is not to replace an official USGA handicap, but to assist recreational golfers in their quest for lower scores.  USGA, USGA Course Rating, Slope, USGA Handicap and Handicap Index are registered trademarks of the United States Golf Association.

Site Usage by the Client
The only golf scores and course information allowed in the System are those of our members.  Any other use of this System will result in termination of membership immediately.  We recommend using Netscape 7.1 or higher, Internet Explorer 6.0 or higher or AOL 9.0 or higher. Any other browser or prior version, FBSDesigns does not guarantee compatibility.  Your browser must have JavaScript and cookies enabled.  To access our system, visit our login page at http://www.fbsdesigns.com/golf. 

Limitations of Liability for FBSDesigns
FBSDesigns assumes no liability for disruptions including, but not limited to, vandalism, theft, phone service outages, Internet disruptions, extreme or severe weather conditions or any other causes in the nature of "ACTS OF GOD".  FBSDesigns shall not be responsible for consequential damages or data lost arising out of the use or inability to use the System.

Cancellation
FBSDesigns automatically bills you ("the client") every period based on the terms set forth by your membership selection.  The amount billed to client shall be determined by the membership selected by the Client.  Billing shall continue until FBSDesigns or the client terminates this Agreement.  FBSDesigns reserves the right to terminate this Agreement without cause upon notification to the Client, if and only if, a valid email address is provided to FBSDesigns.  At that time billing will stop and Client access denied.  FBSDesigns may further terminate this Agreement immediately without notice at any time, if the Client breaches any part of this Agreement.  If, at any point, the Client terminates this Agreement and later reopens account, all golfing data online will be cleared and the Client will start as a "new" member.  FBSDesigns has the right to deny any "previous" member access to the site based on Client history.

The Agreement
By becoming a member of FBSDesigns, the Client has fully accepted this Agreement and only this Agreement and assumes all obligations under this Service Agreement.  FBSDesigns reserves the right to amend or change these guidelines at any time without notice.  Please review this agreement from time to time.
